ANNOUNCEMENT
on the occasion of the judgment of the Basic Court in Podgorica from 12 January 2010 in the proceedings for redress initiated by the children of Munir Sabanovic who was illegally arrested by the Montenegrin police on 27 May 1992 in the vicinity of Scepan Polje and deported to the Foca concentration camp on the territory of Republic of Srpska in Bosnia and Herzegovina where he had been murdered

The Basic Court in Podgorica yesterday reached the verdict by which it awarded half of the amount of damages claimed and awarded to all other children of the victims of deportation by the settlement with the Government of Montenegro from December 2008. The amount of 15000 euros awarded to each child of Munir Sabanovic violates the principle of equality before the law and uniform performance in the same situation.

Our clients will file a complaint to such judgment, determined that such double standard attitude towards victims is not viable.

Bearing in mind this judgment, the denial of claims by the state prosecutor and illegal delays in processing of eight claims filed in 2009 on behalf of 46 victims and relatives of the victims of deportation, we will address the Government of Montenegro on behalf of our clients to ensure application of the settlement agreement from December 2008 to them as well.

A copy of the judgment may be found here (PDF document)
